Digitization and the development of network technology not only makes the replicamaintain the qualities of the originals, but also enables a lot of copies emerge in a short time,which challenges the reservation of the rights of authors to a large extent. Under thiscircumstance, the technical protection measures came into being. The copyright holders use codeand encryption to prevent unauthorized copying or usage to create a new effective way ofreserving copyrights besides legal remedies. Both WCT and WPPT offered legal protection oftechnological protection measures. Leaded by the United States and European Union, manycountries have amended their domestic copyright laws on the basis of the two conventions. Dueto the current technological copyright protection measures, the copyright holders can of controland protect their works while they can abuse their exclusive rights at the same time which isagainst the public domain and the public interest. Like double-edged swords, technologicalprotection measures should be protected and restricted at the same time. China also provideslegal protection for technological protection measures in Copyright Law and Regulations on theProtection of Information Network Dissemination. In the Third Copyright Amendment, exclusivechapter has been complied for technological protection measures, but there are still a lot ofrooms for improvement. This article aims to analyze the legislation of technological protectionmeasures in major countries and in international treaties and to explore the necessity of theadjustment and amendment of relative contents on technological protection measures in theThird Copyright Amendment.
