Study On The Legal Regulation Of "Peng Ci" Behavior

There exists "Peng Ci" behavior since ancient times, the aim of which is to obtainbenefits through blackmail. Along with the development and advancement of society, themanifestations of Peng Ci have been updated with a big change. The tricks have a greatvariety, which make more and more social harmfulness and contrary to one’s expectations.What is more, Peng Ci has the following factors:(1) frequent incidence,(2) large amountof money involved,(3) the range of sufferers is wide,(4) the mobility of criminals isexpeditious. Due to the above-mentioned factors，although a strong crackdown have beenused to counter the Peng Ci acts, they are always difficult to uproot, which meanstemporary solution. This paper aims to hackle the underlying problem of Peng Ci actssystematically. By means of in-depth study of Peng Ci, classification analysis, legalregulation analysis, etc. to seek the best way to regulate and remedy this kind of actfundamentally and make it abundant, typed, materialization. Then achieve the aims thatprotect the people’s rights and interests, public interests and national interests. Inconclusion， some advises are proposed to provide guarantee for this kind of crime fromdifferent points of view.This paper is divided into the following sections:(1) Introduction. This sectionmainly discusses the subject investigated in the thesis, the literature review of the Peng Ciacts and research method of the thesis.(2) The first section. This section mainly elaboratesthe fundamental state of the Peng Ci acts in the aspects of essence, characteristic, etc.Furthermore, make specific classification analysis of the Peng Ci acts in terms of typicalcasus.(3) The second section. This section elaborates the present situation and issues oflegal regulation of Peng Ci acts in our country.(4) The third section. This section makesspecific inspection of the existing overseas legal regulation mode of the Peng Ci acts. Theinspection is carried out in major foreign countries respectively which reach some beneficial conclusions for legal regulation of Peng Ci acts in our country.(5) The fourthsection. This section proposes some advises, which are elaborated from consummating thelegislative system level, improving social security system level, establishing socializedpreventive system level and strengthening populace educational system level, to the legalregulation of Peng Ci acts in China at present. The last is conclusion, which concludes thefull text specifically and summarizes the deficiencies and defects of this paper.
