Research On Perfecting The People’s Mediation System Of Medical Disputes In Hebei Province

Objectives People’s mediation of dealing medical disputes is a new way to solvemedical disputes. This system had been actively promoted and it achieved certain effectsin Hebei Province. For various reasons, however, people’s mediation work of dealingmedical disputes is patchy in Hebei. And the places where have carried out the work hassome difficulties and problems. This paper took the experience of the domestic andforeign medical disputes mediation as lessons and analyzed the problems existing in thecurrent people’s mediation of dealing medical disputes in Hebei. In this paper, on thisaccount, some suggestions were put forward to perfect people’s mediation of dealingmedical disputes in Hebei, it expected to be able to further improve and perfect themediation work there, to promote medical disputes to be solved reasonably and legally, toconstruct harmonious doctor-patient relationship, and to ensure the healthy and smoothdevelopment of medical and health services.Methods1The method of literature retrieval Through literature retrieval method, thispaper collected research literatures of related experts and scholars which about themedical disputes mediation and collected data and information which was provided byrelevant organizations and personnel. The main source of literature including foreignlanguage database such as HealthSTAR, Chinese databases such as CNKI, VIP citationdatabases, Founder database and HowNet, as well as some websites of Hebei JusticeDepartment, Health Department, and GOOGLE search site, etc. Through literatureretrieval method we were able to systematically master the domestic and foreign researchresults which related to medical mediation, to understand the current status of research,achievements and successful practice and problems of people’s mediation of dealingmedical disputes.2The method of material analysis Most information are qualitative data throughliterature retrieval method and interview method. This paper mainly sorted and analyzedthese data by the method of induction, deduction, reasoning.3The method of interviewAccording to the interview outline which has been designed to interview. Theparticipants are mediators of people’s mediation committee of dealing medical disputesand the staff of medical institutions who are responsible for dealing with medical disputes.The main contents are the advantages that people’s mediation of dealing medical disputescompared with other ways; the current problems of people’s mediation mechanism ofdealing medical disputes; and the suggestions to perfect this mediation.Results1Hebei Province is facing more serious doctor-patient relationship problems,many hospitals are deeply troubled by medical disputes. The people’s mediation system isa legal system to deal with those disputes. 2Hebei Province attaches great importance to developments of people’s mediationwork of dealing medical disputes: the government actively supports and urges all regionsto establish people’s mediation committee of dealing medical disputes and renders aservice to the workplace, funds and personnel, etc. In general, however, people’smediation work of dealing medical disputes is backward and patchy.3The main problems of people’s mediation work of medical disputes in Hebei are:many local people’s mediation committees of medical disputes lag behind requirementsof the ministries such as Justice Department and NHFPC; the number of mediationaccomplished by people’s mediation committee of dealing medical disputes is so lackthat this way has not yet become a main channel; mediators’ quality can still be improved.Conclusion1On account of its economy, convenience and nongovernmentalcharacteristic people’s mediation of medical disputes has outstanding advantages insolving medical disputes and defusing doctor-patient conflicts. It should be vigorouslypromoted.2Aimed at the problems existing in people’s mediation work of medical disputes inHebei Province, this paper puts forward some corresponding strategies and measures: tostrengthen the role of government in the people’s mediation mechanism of medicaldisputes; to establish and perfect the guarantee mechanism of people’s mediation work ofmedical disputes; to strengthen the publicity of this mediation; to reinforce the mediatorsteam of people’s mediation mechanism of dealing medical disputes; to regularize medicaldisputes of the committee; to perfect the system of medical malpractice insurance; and tolink up people’s mediation mechanism of dealing medical disputes with judicial process.
