Corruption and bribery crime is a crime type positions facing countries in theworld, with the development of China’s reform and opening up and economicconstruction, national staff persons suspected of the crime of corruption isincreasing, investigate corruption cases related to the party and thegovernment’s image and judicial credibility problem has been widespreadconcern in the community, especially leading cadres, corruption and briberycrimes have become a hot issue of social concern.But in recent years, more and more corruption crime imbalance caused by thecommunity’s concern and controversy, sentencing imbalance is not conduciveto carry out the duties to curb crime and the fight against corruption, thejudiciary should attach great importance to and strive to resolve.This analyze is followed by four parts of criminal sentencing for corruptionand bribery imbalance:In the first part, through analyzing and summarizing the case of corruption andbribery crime in a grassroots Shanghai Procuratorate from2010to2012, thecorruption and bribery crime sentencing uneven performance characteristicsare summarized, and the hazards of this situation is analyzed.In the second part, the reason of the imbalance in sentencing for crimes of corruption and bribery crime are analyzed from three aspects: legislative,judicial, illegal.In the third part, the legislation and the existing criminal law and sentencing ofsome Western countries in dealing with corruption cases were compared, andthe experience of the disposition Singapore, the United States and othercountries to punish corruption cases are learned.In the fourth part, through the comprehensive three parts, the solution againstcorruption crime and bribery sentencing imbalance is suggested fromlegislative, judicial and oversight.
