The Research On The Legal Problems Of Payment Crisis Of The Realestate Trust In China

Since2010,the scale of the real estate trust in china has been growingrapidly,but with the control measure in the real estate industry, thedeveloping pattern of the real estate industry has also changed,the risk ofthe original developing pattern has gradually emerged.The cashingamount of the real estate trust in2013has been expected to reach400billion yuan,nearly twice of2012. Especially with the coming of paymentcrisis in the second quarter of2013, many legal problems arefollowing.This paper is divided into four chapters to discuss.The first chapter starts from the reality of the real estate market inChina,and then extended to a variety of systemic risks and non-systematicrisks in real estate trust in china.The second chapter starts from thepayment crisis which could appear recently,analyzes the causes with thelegal and market factors,and uses case analysis method. The third chaptermainly explains the supervision of payment crisis in real estate trust inchina.The fourth chapter provides some new thoughts for the supervisionand related innovation of real estate trust in china. We believe that the payment crisis of large scale of the real estate trustunlikely happen in china now, but the legal supervision in this aspectcould not relax. We should start from the internal supervision of the trustindustry, and then together with legal and policy control of thesupervision department.We believe that the real estate trust will havebetter future in china.
