The Research On The Main Penalty Of Responsible Personnel In Unit Crime

Unit is a special subject of crime in the Criminal Code. ChineseCriminal Law stipulates that the principles applicable penalties for unitcrime combine "single-penalty system" with "double punishment". Nomatter which principles are, the responsible personnel in unit crimeneed to take responsibilities for their crime. Given the important role ofresponsible persons in unit crime, this paper intends to discuss fiveaspects of crime-related problems in the unit responsible personnel.First, the paper expounds two doctrines and all parties’ views aboutthe responsible personnel in unit crime which take the responsibility inCriminal field, aims to discern the theoretical basis for sentencing theresponsible personnel in Criminal Law. Then, the paper analyzes theircommon characteristics as well as the different identified standards aboutthe responsibility for personnel in charge and other directly responsiblepersonnel. After that, in order to define these two subjects well, the articlegives a brief comparison on the differences between them, and analyzing the relationship between the two subjects combining with a real case.Andthen, comparing with the responsible personnel and the natural person’sresponsibilities and giving a comparison between each other in thepenalty sentencing principles. Finally, the article discusses some difficultissues on criminal law which related to the responsible personnel.Unit Crime is a hot issue in the study of criminal law. The researchrelated to the responsible personnel is just one of entry point.
