The Discussion Of The Legally Dilemma And The Perfection Of The Public Trust System

With the development of our country’s power and capability, and people’s living standards continues to improve, people’s charity awareness is growing, the public welfare undertakings have developed rapidly as well. However, in the rapid development of public undertakings at the same time, the development of the public trust has been stagnant. The reason mainly includes: the lack of detailed rules for the implementation, the lack of regulation, the lack of enough social awareness, and the singleness of funding sources. These problems have been seriously restricting the development of public trust in our country. In contrast, although some problems are existing, such as the running cost is too high, and the supervision and management system is not scientific, but some developments have been achieved in the long run of practice. In addition, due to the foundation for development of our country started early, in the present stage, the public awareness, system architecture and fundraising mechanism in our foundation have more advantages than the public trust. It is undeniable that our public trust is continuously improving, but establishing a set of perfect system can not be done in one day. The writer believe that in order to complete our public trust, we must realize it objectivity that the function of the public trust and the foundation are different but complementary. Only by combining the practical situation, promoting the fusion of public trust and the foundation system, can the system of our country’s public trust be improved, so that our public welfare undertakings in our country be better promoted.This paper consists of introduction, text and epilogue. The text includes three parts: the first chapter is mainly about the overview of the basic theory of public trust and foundation, and the academic analysis of the relationship between them. The viewpoint of “merging theory” was given in this part. By analyzing the current legislation and practical situation of our public trust, the main problems existing in the public trust were pointed out in the second chapter. In the third chapter, the practical emerging experience of “merging theory” in America was given, and for the next part, the feasibility of the theory in China was analyze. At last, putted forward specific ideas of perfecting our country’s public trust.
