Since the reform and opening up, China’s economic strength significantly increased, people’s living standards have improved, city of the word from the proposed also has gone through thirty years, happened to turn the world upside down change of our country city appearance. Especially in the past ten years, city process a step further. China city of processes and patterns are also in the process to determine:the rural reconstruction for the town, and then the town gradually becomes small city,big city and international metropolis. But at the present stage, city and rural,two coexisting, have all kinds of connections with each other with links. The expansion of the city scale, city of depth must be dependent on adequate land, and most of the construction of city land in China is nearly saturated, so the way in which the acquired more land for the construction of the city? To obtain land should be how to reasonably use? From the present stage of our country’s situation, that is, through the land expropriation to gain land for construction purposes. But in the process of land expropriation, there exist many problems. For example, the collection of the main uncertainty, collection of the necessary standard of,public interest, definition, land expropriation of land owners after compensation. Institutional arrangements for land expropriation not only decides the process of urbanization in China can be sustainable,but also relates to the rights to subsistence and development right and property of the citizen of our country problem.
