Water intake right as the core of water right was born in the late Qing Dynasty in China, while it has similar to the coast and preemptive priority right system oversea. No matter what kind of system, its core is the water intake right to object of the research, the definition of water rights, water rights, water rights acquisition, property of water right circulation, etc. According to the four elements of subject, object, attribute, behavior, water rights should be defined as: "The water intake right refers to the right, through administrative license, or the nature of the water conservancy facilities, or the use of legitimate from the surface and underground water resources for economic and reasonable use of quasi usufructuary right." Because the water resources is extremely important to reflect the status of the relevant provisions of the public law, water right transfer system in China cannot without the administrative management and intervention.The market of circulation and the required is not only a contradiction but also a inseparable, as a important part of the construction in the theory and practice of water right for water market and water bank system in China.
