Study Of Protection Of Bank Financial Products Customers In Chinaunder Regulation

As the fast development of bank financial products in China, in the process of regulation, all kinds of problems and conflicts between the banks and financial products customers emerge. The emergence of those problems not only unfavorable to the development of the bank financial products, but also not conducive to bank financial products consumer protection. After the research related to the basic theory, from the regulatory perspective of the legislation level, subject level, authority level, application level and supporting systems, consumer protection regulation of bank financing products problems are analyzed and studied in the article, and to draw lessons from foreign experience and advanced practices, so as to put forward the regulation horizon, consummates bank financial products consumer protection countermeasures in our country.The thesis is divided into:The first part is the summary of theories of legal protection for bank financial product customers. This part differentiates bank customer and bank client, analyzes the concept of bank financial products, and then define the concept of bank financial product customers and illustrates its basic characteristics. Afterwards, the thesis analyzes and discusses the theoretical basis of legal protection for domestic bank financial product customers, and then explores the basic principles of legal protection for bank financial product customers.The second part, on the basis of the first part, makes analysis of the problems existing in the protection for domestic bank financial product customers under regulation. Through the analysis of problems, it is found that under the separate regulation of financial regulation system, there are the following problems: the legal protection for domestic bank financial product customers is insufficient, the regulation purpose and authority for bank financial product customer protection is ambiguous, the subject status of bank financial product customer in regulation institute benefits protection is unclear, the procedure of bank financial product customer rights protection under regulation system is unsound, etc. Hope to find answers to solve, from the perspective of the problem itself.The third part introduces the exotic learning of bank financial product customer protection under the financial regulation. After the financial crisis, based on its national conditions, countries have adopted for the systemic regulation reform of consumer protection. This part combined with the United States, Britain and Australia, the three more representative countries in the world financial regulatory reform, especially for consumer protection regulation reform, the experience and lessons of learning and research, in order to reference to successful experience of countries in the world and be able to get some inspiration.The last part, based on the comprehensive consideration and reference on the basis of part one, two, three, from a perspective of regulation, puts forward several countermeasures of perfecting our country’s bank financial product consumer protection. The thesis, under the view shed of regulation, combines current domestic regulation status and exotic learnable experience. From the aspects of legislation, subject, functions, procedures, and supporting system, the thesis proposes a series of regulation suggestions for perfecting domestic bank financial product customer protection, including enhancing the systematicness and operability of bank financial product customer protection, making up the loss of the subject status of bank financial product customers, clarifying the value and responsibility of bank financial product customer protection, improving the effect of relief for the rights of bank financial product customers, and establishing a healthy supporting system for bank financial product customers.
