Research On Legal Problems Of Under-forest Economy

After the finishing of the reform of collective forestry, a new wave of developing under-forest economy has been raised across the whole country. As a new way of forestry production and economic phenomenon, under-forest economy is an important channel of farmers’ income and the main contents of new rural construction, and it also has rich production value and scientific content. This paper analyzes the research status and developing evolvement of Chinese under-forest economic, and fatal significance of developing under-forest economic. But during in practice many problems has been encountered, currently reform and forest economy mainly depends on the development of forest tenure policies, normative role of law is clearly insufficient.Firstly analyze the basic Problems in under-forest economy. Make a clear definition of the basic concept of under-forest economy, then explain the background of it. Secondly, analyze the existing legal problems in practice of under-forest economy. There is controversy of under-forest economy ownership, it also very difficult for farmer to achieve management rights, the lack of effective supervision and legal awareness of under-forest economy are also very tough. Thirdly, mainly use comparative analysis, which is based on the study of foreign policy and law of agroforestry, proposes that we can learn the measures of credit preferential, tax policies and forest tourism. Finally, discusses the proposal of under-forest economic system. Our country needs to establish the law of under-forest economy system, Ownership and usufruct should be clear. This paper puts forward to strengthen the supervision of under-forest economy, achieve effective coordination of conflict and ecological protection of rights and rights, and strengthen the legal awareness of under-forest economy. The author expects these measures can promoting China’s forest economy and standardize system to system roads to meet the needs of the present stage of China’s economic and social development.
