Study On The Problems Of Compulsory Medicalprocedureof Mental Patients

The new "criminal procedural law" revised in 2012, added provisions of the mentally ill criminal law the compulsory medical procedure.Breaking the previous criminal coercive legislation procedures related to medical field situation, marks the overall framework of our mental patients forced medical procedures have been established. However, as the first of a series of legislation, because of the lack of details to consider,mental patients forced medical procedures in the operation process of the time also exposed a lot of problems. Therefore, from the theoretical level of the mental patients forced medical procedures are necessary to explore.This paper is divided into four parts, is intended to explore the mental patients forced medical procedures. The first chapter is the basic theory of compulsory medical procedure on the patients with schizophrenia were summarized, combined with its connotation, legal nature, historical evolution, the program itself reflects the value conflict, interpreted from the different dimensions of the mental patients forced medical procedures.In the second chapter, under the background of new criminal procedure law, the mental patients forced medical procedures within each program to analyze the deconstruction. The third chapter based on the defects in legislation and practice in the current dilemma, analyze the deficiency of mental patients in our country compulsory medical procedure. In the fourth chapter of our mental patients forced medical procedures and existing problems, put forward countermeasures and ways to improve.
