Due to the continuous advance of legal process and demands of the times of social development, the Third Plenum of the CPC eighteenth expressly abolished the system of labor reeducation in Comprehensive promoting the process of building the rule of law.The content of this conference involved only a few dozen words through labor reeducation, but it provides us with a good opportunity, by combing and consolidating all existing education which exist only in name to reconstruct patterns of social prevention system, which touches the sensitive nerves of social security and control of state power and directly faces the human rights conflicts between the honesty citizens and offenders. On the one hand, we can not ignore the opaque phenomenon of legal activity itself and tolerate the arbitrary abuse of police powers; on the other hand, we must face the reality of accelerate social mobility and the ability of crime prevention of urban and rural are rather fragile, and bear the pressure which is brought by the increasing violations. This article argues that the Construction of the education and correction system of violations, in terms of our innovation legal system, which not only marks the birth of a new legal system, but also a brave attempt to build a socialist legal system with Chinese characteristics.This paper adopts the methods of literature analysis and comparative analysis and so on in the discussion process, firstly on the basis of commenting the theoretical research of "post-Reeducation through labor era", through the comparative analysis of the research to discuss the historical inevitability of constructing the education and correction system of violations; Secondly, based on the necessary analysis of the status of the education and correction of violations, finding the existing problems and causes, and then thinking to construct system to deal with the existing problems and issues that may arise, in order to benefit the construction of the education and correction system of violations.
