| With the development of marine resources and continuous enhancement of the marine status, coastal countries have continued to strengthen the influence of the surrounding waters, in order to safeguard maritime rights and interests. Subsequently, the maritime delimitation dispute between the countries is intensifying continuously, which is mainly in the delimitation of the continental shelf and exclusive economic zones. The promulgation of "International Convention on the law of the sea" provides a good reference for the peaceful settlement of the boundary dispute, however, the Convention does not make a clear formulation to apply to the maritime delimitation specifically. Therefore, the use of which demarcation principle in the actual demarcation case has become the focus of dispute between the countries. Specific to our country, our country’s coastline is long and narrow and there are numerous maritime neighbors. As a result, maritime delimitation issues which we face are the complicated. For a long time, due to the relative ease of the Yellow Sea maritime delimitation disputes, East China Sea and South China Sea has been the focus of our attention. But in recent years in the Yellow Sea, delimitation disputes between China and South Korea emerge gradually, and we have to arouse attention. The delimitation disputes mainly include the exclusive economic zone and continental shelf delimitation dispute. The two countries have different views on the principle of delimitation, which makes China and South Korea need to reach an agreement for a peaceful settlement of the dispute. This paper uses the delimitation disputes of the Yellow Sea between China and South Korea as an example, uses the theory of international law to analyze the delimitation view held by China and South Korea, and also draws on the experience of international judicial cases to explore a practical way which is helpful to resolve the disputes peacefully. Solving the delimitation disputes of the Yellow Sea can learn from the experience of East China Sea and South China Sea, and the smooth settlement of the the Yellow Sea boundary dispute can, in turn, guide the delimitation of East China Sea and South China Sea. Therefore, it has great practical significance. |
