The modern and contemporary Explicit Deposit Insurance Legal System is established with symbol of the publish of Glass-Steagall Act in the US. As a system has being developed for century, it acts the role of depositor’s benefit protector, financial system stabilizer, and social economy boost. For information of 2014 data, there’re 112 nations of the world have established deposit insurance legal system. China proposed to establish the system in 1993, and the Regulation of Deposit Insurance was published in Apr.2015 after 20 years of research and prepara.tion.This paper is to study and research on deposit insurance legal system on the basis of theory and practice according to internal and external situation.The paper is composed of 5 chapters. First one is to introduce what deposit insurance legal system is, by comparing the difference between Explicit and Invisible deposit insurance legal systems to indicate the advantages of Explicit Deposit Insurance Legal System with support of the system theory, value and defect. Second part is to analyze elements of deposit insurance legal nexus, and to find out that surety insurance is the nature deposit insurance contract, so the deposit insurance organizations have rihgt of recovery, Deposit insurance is in the nature of public interest. Thrid part is to state the importation of Explicit Deposit Insurance Legal System in the perspective of the relationships between the system and banks fair competition, the other financial protections, and interest rate liberalization. Fourth is about comparison between the Regulation of Deposit Insurance and global system of deposit insurance code. The last part is to illustrate a couple of problems shall be handled during completing the Explicit Deposit Insurance Legal System of China.
