Study On The Traffic Accident Responsibility Identification Of Private Drive Drunk

China has a long history of wine culture. For thousands of years, alcohol plays a very important role in social life, people tend to express their emotions through the wine in life. In modern society, the wine is still influencing various aspects of people’s life. Along with the national living level increasing, people have more and more private cars, which makes the liquor traffic safety problems driving has been increasingly serious. In order to remedy the victims’ loss of motor vehicle traffic accident, all the countries in the world actively to strengthen the use of motor vehicles and motor vehicle related specifications and other aspects of the legislation of tort liability. In our country, along with the "road traffic safety law" and "criminal law amendment (eight)" has implemented, the service of designated driver as a new thing emerged. But the development of new things always goes through a long and tortuous process, the industry of designated driver is no exception. Because of some characteristics of the related system lag and its own inherent, the industry of designated driver especially in private designated driver, the operating status is lack of standard, various disputes incidents continue to occur. In order to solve these disputes, resolve contradictions in a timely manner, maintain good social order, this paper is based on the analysis of the different circumstances of designated driver cases, sums up the common focus of controversy, and then focus on the issues. It aims at effectively solving the disputes, resolving conflicts, and putting forward some reasonable suggestions of their own to solve these problems.This paper is divided into four chapters. The first chapter mainly content is to introduce the two different types of designated driver, through the case analysis to summarize their common focus of controversy. The main contents of the second chapter and the third chapter is based the case listed on the first chapter. To system analysis and study of the legal problems involved in the case, the main contents are:the basic problem of the concept and characteristics of private designated driver, the legal relationship of private designated driver between the main body and traffic accident responsibility cognizance and the responsibility of compensation for damage. The content of the fourth chapter mainly through the analysis and thinking of the same type of cases of private designated driver, expounds the bottleneck problem of current drinkers driving face, and puts forward some countermeasures according to these problems.
