Since the enactment of the road traffic safety act,as a new industry,the generation of alcoholic drinks has emerged in some large and medium-sized cities.In 2011,when the criminal law amendment(eight)included drunk driving in the adjustment of the criminal law,the wine descendant driving industry began to develop rapidly and became widespread in all major cities of the country.Along with the rapid development of the industry,a large number of road traffic accident responsibility caused by generation of driving began to appear,because of the lag of relevant laws and judicial practice of wine offspring driving on the law applicable to problems in confusion.Therefore,this article will start from the basic concept of generation of driving behavior,according to the different categories of generation of driving behavior,legal relation nature of wine offspring driving behavior,mainly to explore the different nature of legal relationship in the cognizance of wine offspring driving responsibility main body,in order to handle with wine offspring driving problems in judicial practice and legal disputes caused by providing some theoretical basis,promote the benign and healthy development of the car industry.
