Studying On Legislation Of Personal Information Protection On The Background Of Cloud Computing

With the appearance of a new type of technology, cloud computing brings new patterns of information storage and interaction on the Internet. Cloud computing offers new experiences and great convenience to the users with its huge scale, virtualization and universality. Meanwhile, it also brings a big challenge to the traditional legal protection of personal information. On the other hand, the economic value of personal information which is regarded as the same as petroleum increases constantly. As a result, more and more agencies and companies cast greedy eyes on personal information, so it is very urgent to legislate and improve law systems on protection of personal information.It was a little late when our country make regulations of protecting personal information and there are seldom researches on the protection of personal information in the background of cloud computing. Recently, our county’s law system shows the features of scatter, low class and lack of specialized legislation. The protection and use of personal information are the two sides of this problem. How to protect personal information from infringing and maximum the function of personal information is the most important subject all around the world and also the core value of this dissertation.This dissertation here use the methods of reference analysis, compared analysis and system analysis. It starts with making clear the concepts of cloud computing and personal information and it is based on the value and necessity of protecting personal information. And also this dissertation talks about establishing the right of personal information which is the object of personal information protection. Besides, the features of this right, the source of infringing and the balance between protecting and using are discussed and analyzed in this dissertation. Furthermore, it gives several effective advises about the establishment and improvement of personal information protecting law system with the analysis and comparison of law systems and patterns between our county and foreign countries..
