The traditional business method has long been considered rules and methods of intellectual activity simply which is excluded from patent protection. But with the arrival of era of information societyknowledge economy, computer software and network technology has been developed rapidly, the modern business method discussed in this paper are produced by the combination ofthe business method with computer and network technology.In the leadership of America Europe and Japan, it is no doubt that business method can be the objection of patent protection.There are many countries are actively adjust their patent policies by following America,Europe,Japan, the business method has been took into the scope of patentable.In this circumstances, it is worthy studying that how to formulate the law policies which is related to the patents for business method based on our county’s basic national conditions and keep pace with the times.On the basis of making clear the definition of patent of business method, this paper compare the patent of business method of America, Europe and Japan, to find their experiences and lessons, putting forward the countermeasures and suggestions which are suit for our county’s basic national conditions by combining our country’s standard of censorship and the status quo of censorship.This paper has three main sections:The first part of this paper mainly study the basic theory of the patent of business method. In this part, based on a variety of perspectives, business method and the patent of business method are defined first, then analysis and explanation the patent censorship of business method based on the current state, to lay a foundation for the explanation of the paper in later. The second part of paper mainly analyse the problems in the patent censorship of business method in our country. By studying the censor authorization principle, censor procedures, judging method, the problems in all aspects will be pointed.The third part of paper mainly study how to improve the patent censorship of business method in our country. The censorauthorization principle, censor procedures, judging method and so on which are related to business method of America, Europe and Japan are discussed at first, on this basis, the principle, method and procedure of each case are summarized and analyzed, to provide reference for improving the standard of patent censorship of business method.
