With the development of the Internet in our country, more and more TV programs and movies enter China through the way of web, and they have become an indispensable part of people’s entertainment. The Fansub Group, which makes an important contribution in this process, has played a major role in translating and transporting the programs in to the country. The Fansub Group tries to translate the dialogue into Chinese, and to make a new subtitle from that, which gives a great currency to the programs that were not easily understood and accepted before due to the low level English or other language proficiency.However, because of the lack of approval from the proprietor of the programs, the translations and sub-productions of the Fansub Group are always in controversy. There are two major behaviors performed by the Group. First, it translates the Non-Chinese dialogues and contents into Chinese, using subtitles hanging in the screen of the programs. They also put the electronic files of subtitles on the Internet so that everybody could download the documents without any restraint. Second, some Fansub Groups go even further to compile the movie or TV program file and the subtitles and make it into a new electronic file with an easy way of transportation. People do not need to download the movie and the subtitles separately, and one integral file is more conveniently enjoyed. And these two kinds of behaviors have internal relationships as well as obvious differences. The essential part of translation lies on the foundation of the original transcript, and it requires the foreign words arrangement and organization. In other words, the translated subtitles are the reproduction of the original transcripts, so the translator must qualify their behavior according to the author’s requirement. And the endeavor of compiling of movies and subtitles involves the situation not only about translation but also about the distribution of original movies on the Internet. The original movies, first illegally put up on to the Internet, lack the ability to be accepted and spread to a wide audience. But with the help of subtitles, the excellent movies quickly get on their way and become widespread because the difficulty of inscrutable language is eradicated. In this way, the production of subtitles makes the situation of illegally spreading the unauthorized movies and programs even worse.Fansub Group is not a unique phenomenon of China, and it is found almost in every country with a well-developed Internet system. And the availability of Fansub Group is in proportion to the cultureacceptability of the country and in negative correlation to the country’s regulation level. Most countries give their stipulation about the Fansub Group phenomenon based on the country’s legislation tradition and its history context. China is still in the exploration of legislation and regulation of Fansub Group.This dissertation focuses on the copyright law discussion of the Fansub Group, based on the research of it’scontemporary condition. The consideration begins with the origin of the Fansub Group, and talks about the development. Along with the procession of Fansub developing, its behavior varies, enriched with much more content as well as a lot of legal issues. These issues include whether the procession of subtitle- production is under approval or not, and how the illegal distribution of the movies and programs impair the right of the copyright proprietor. Because most proprietors are abroad, the third part discusses the attitude and approach of the International society, mostly in the realm of the relatively systematically legislated countries of copyright law, such as the USA, Japan, and also involves the International convention signed by China. And at last, based on the experience of these countries with regard to legislation and regulation, the article gives advice to our country.
