Study On Administrative Action Classification

Currently, the problems of administrative action classification have four aspects, such as subjects, object, technique and classification effectiveness. There are three attitudes in dealing with administrative action classification problems: Firstly, starting with the concept of administrative action, advocate the concept that remodeling to accommodate the needs of classification of administrative action. Secondly, considering classification from the administrative action itself, advocate classification reform to adapt to the connotation of administrative action. Thirdly, focused from administrative action, they advocate the fully reconstructed concept and classification of administrative action, replacing the current administrative action classification theory. The author believes that the classifications of administrative action have two fundamental questions: Firstly, there is no distinction between administrative action classification and specific administrative action classification. Secondly, there is no distinction between administrative action classification and division of administrative action. Although the overall reconstruction from the shackles of administrative action parts of the theory, but still need to distinguish classification and division. This is exactly the point of view of the three not well solved the problem. The reconstruction concept could be adapt to the current administrative practice or not is also questionable in our country. Only through concept expanded and supplemented by Category reform can we solve administrative action classification problems effectively. To build administrative action classification system as the goal to streamline the remaining so-called classified in the division of administrative action be introduced. So, the theory of administrative action classification will be more perfecting.This article is divided into three parts: Firstly, introduce the relevant principles of Administrative action classification, such as introduces the concept of administrative action classification, features and necessities. Secondly, summarizes the problems and causes of administrative action classification. We analyze the reasons for administrative action classification problems are: historical factors, objective factors, human factors and social factors. Finally, under the rule of a government background, we should put forward a series of recommendations for improve administrative action classification. For the current classification problems, we have put forward that clear classification of subject, to establish the principle of classification, unified classification criteria, building classification system and other recommendations. I hope to that this article has benefits for administrative action and it`s theoretical system.
