On Improvement Of Procuratorial Reconciliation System On Civil Matters

The procuratorial reconciliation on civil matters is not from the theoretical research, nor from the law, it is a dispute settlement mechanism evolved in judicial practice. Procuratorial reconciliation on civil matters is a working mechanisms which refers to the People’s Procuratorate in the review of applications for civil legal supervision cases,which the procuratorial organ hosted parties reached the purpose of settling disputes and resolving conflicts on the premise of Voluntary.Procuratorial reconciliation on civil matters although has a solid legal basis and practical basis, however, the existing law does not require the application, applicable procedures, relief programs of the regime,and does not require the effectiveness of agreement and other issues, which makes the system was practiced to lack of app ropriate basis.This paper consists of four parts. The first part writes a basic overview of procuratorial reconciliation on civil matters. The second part describes the present situation of procuratorial reconciliation on civil matters, in order to pave the way of writing the third part. The third part, by the present situation that writing in the second part and found that the problems of procuratorial reconciliation on civil matters; fourth part, for the problems to think about how to improve procuratorial reconciliation on civil matters and try to build procedures that procuratorial reconciliation on civil matters have.
