Research On Constitutional Guarantees Of Citizens’ Housing Rights

Since ancient times,clothing,food,housing and transportation are the four basic necessities of everybody. Among them, housing, as an indispensable basis factor for the human survival and development, has always being the focus which the society and people pay more attention to. Housing problem has become a hot research topic in the field of economics, sociology, politics and so on. And in the legal study, to guarantee citizens’ housing rights is attracting increasing attentions of jurists. In a sense, it is possible to say that with the development of society, people’s sense of personal rights improves gradually. To view most housing issues and solve housing problems from the angle of human rights have been an international tendency. However, previous studies mainly were based on the private law, lacking of the study on public law. In addition, the realization of housing rights in China is so terrible that some people have to support the overpayment of housing price and some ones cannot apply for low-income. To make matters worse, the public power could harass some people now and then. Therefore, besides guaranteed by general law, housing rights should also be brought into the protection of constitutional system. The research on constitutional guarantees of citizens’ housing rights is of great practical significance.This paper, besides the introduction and conclusion, are made up of four parts. The first part explains the basic theory of constitutional guarantees of citizens’ housing rights. It defines the basic meaning of housing right and compares to the similar concepts. Then it discusses the theoretical basis and significance of the constitutional protection of housing rights. The second part studies two housing rights protected mode in the world for the sake of gaining some inspirations. The third part analyzes the problems in the constitutional protection of housing right in our country by reflecting the history and reality of constitutional guarantees of citizens’ housing rights. The fourth part puts forward some specific proposals to construct and improve the legal system of constitutional guarantees of housing rights.
