Kang Dong is the late 19 th century to the 20 th century 30-40’s famous jurist and legal reformer in China, his legal thoughts and legislative activities affected by this era, but also in the period, his legal thoughts and legislative activities had a major impact. Kang Dong has been through the traditional Confucianism education, through select scholars for public office on official career, has left to Europe, the United States and Japan for legal research, how to view the traditional legal thought and western legal thought was worth wandering about. Kang Dong’s legal thoughts in the late Qing period and the period of the republic of China has a large, fundamental difference, he had experienced the separation from advocating rites to adhere to the unity of Confucianism transformation. Of which repeatedly, tangle, twist is legal thoughts, legal reform reflects this period even complex, twists and turns of the development of society. Which reflect in criminal law thought, also has important significances.
