Practical Research On The Social Investigation Of Juvenile Criminal Cases

As one of the three major public nuisance, juvenile delinquency, which has long been a serious social problem hindering the development of the society. In our country, as an important factor affecting the social harmony and stability, juvenile delinquency accounts for the proportion of the criminal has maintained at a high level, and has an expanding trend. In X city, SiChuan province, for example:Basing on the statistic of public prosecution in 2010 to 2014 in the procuratorial organ, since 2014 the proportion of the number of minor crime accounted for 8.0% of the total, then 8.6%,12.4%,9.8%, 12.4%, high crime rates of minors, and it’s easy to find that the criminal age is getting younger. It also confirmed the problem of the minor crime which is still a major problem in today’s Chinese society, To prevent and reduce juvenile crime has become the priority of the judicial work. This article aims to discuss and analyze the problems of juvenile crime on the background that some special procedures has been enacted on the Criminal Procedure Law In the meantime, some measures would be mentioned either in order to standardize and improve the system of social investigation and give full play to its positive role, making sure that the effective implementation of the Criminal Procedural Law.In addition to the introduction, this paper is divided into four parts. The first part is mainly about the development of juvenile criminal case and the relative social investigations at home and abroad. Among them, the major foreign Anglo-American law system is on behalf of the explication of minor criminal case social investigation in United States and Britain. And domestic ones is mainly about social investigation in the minor criminal cases. And the condition of our country’s legislative development and practical situation are introduced; The second part is the analysis of some relative theories about social investigation of juvenile delinquency, such as the concept of social investigation system, social investigation, the legal basis for the interpretation and the importance of procuratorial organs the social investigation was analyzed. Thus it is concluded that the the necessity and importance of procuratorial organs in those social investigation. The third part:in X city, the main characteristics and theoretical confusion and practical difficulties in procuratorial organs are analyzed during the process of social investigation of the minor criminal case. The fourth part:According to those dilemmas, and in order to the legislature and to strengthen cooperation in related departments, perfect the laws and regulations, which in turn drove the social investigation of minor criminal cases to obtain actual effect, some targeted measures should be put forward in the process of carrying out the social investigations.
