| The rapidly growing E-commerce has resulted in unprecedented challenges to the established rules and principles that were developed for conventional transactions. As one of the components of E-commerce, consumer-to consumer (C2C) transactions has been quickly accepted and continuously promoted by Internet users due to its flexible transaction parties and wide trading scope.However, the virtual nature of the transaction parties results more risks and uncertainties to C2C transaction, and thus brings a series of problems. Traditional laws on commerce become inapplicable in many aspects in solving problems of C2C online transactions. While the C2C transaction is a new phenomenon to the world, the correspondent law system is basically still at exploring stage. So, how to establish healthy and orderly new rules is currently an urgent issue to be solved.This paper attempts to take C2C online transaction mode as its starting point, take C2C’s largest online trading platform Taobao as specimen, combining with the research results of e-contract under E-commerce Trade Law, to analyze several law issues about online transaction contracts. This paper includes five parts. Chapter One is an overview of online transaction contract. It is mainly about the definition of online transaction contract and its trading mode, particularly analyze the transaction procedure of Taobao; Chapter Two focuses on the legal status of Taobao with C2C transaction mode; Chapter Three analyzes the formation and effectiveness of C2C online transaction contract; Chapter Four is about the rights and responsibilities of the Buyers and Sellers during the enforcement of C2C online transaction contract, and further analyzes Taobao’s relatively mature evaluation system; Chapter Five is about the dispute resolution mechanism of C2C online transaction contract. |
