With the advancement of urbanization, a large number of population into the city, together with a large number of high-level high-rise buildings appear constantly, even more than the parties to the same all become the norm of building, building differentiation ownership system gradually to be the concern of the theory and practice in our country, which was established in the property law in our country. Of property law in our country to construct the system of building differentiation ownership, however, still cannot solve the problem of attention in practice many, for example, the question parking space ownership dispute in practice, and club, the ownership of external wall of buildings. The author thinks that, these disputes are around the definition of proprietary parts and common parts of building differentiation ownership, their relation to the problem discussed scholars although in theory, but always can not provide effective solution to the problem, therefore, the author selected "the ownership of buildings proprietary parts and common parts of shallow judgment" this topic, the technical secondary school of building differentiation ownership have parts with a total of judgment on the basis of analysis. The research idea of this paper is to first illustrates the related theory of building differentiation ownership system, analyzes the problems existing in the system of building differentiation ownership, next to the distinction between the countries and regions to establish outside of all buildings proprietary parts and common parts judgment standard, investigation and analysis summarized a set of reasonable system of proprietary parts and common parts judgment standard, to define the differentiation of all proprietary parts and common parts of building area. This article also will use summed up the judgment on the basis of the practice problems parking Spaces, the roof platform, the external wall of dispute for specific analysis.
