A Study Of Legal Issues On Environmental Pollution Liability Insurance

China’s economy developed rapidly in the industrial era.But the pollution was very serious which made human life and health facing a great threat. In recent years, Beijing which was the capital of my country were often shrouded in haze. How to control the haze had drew everyone’s attention.Many laws and regulations were promulgated to expectate to alleviate the side effects of the economic and social development,but the existing legal and administrative systems could not catch up the growth of pollution.The problem could not be solved and some pollution accident would cause a huge loss, if the victims could not obtain reasonable compensation,it would cause social unrest, if the victims received compensation, companies were often overwhelmed and bankruptcy which is also harmful to China’s development.Other countries’ s solution to this problem was building the pollution liability insurance system. On one hand, victims could get compensation and on the other hand it could boom our insurance industry.After several years of development this system had been mature in foreign countries. China had gradually established the environmental pollution liability insurance system,but there were many problems such as the narrow coverage and single insurance organization.This paper present a number of recommendations on the study of basic theory.This paper had five parts: The first was exordium which was mainly introduced why I choose this topic and the research methods in this paper.The second part was an overview of environmental pollution liability insurance, description of the meaning of this system,the basic characteristics of the history of the development of a mandatory, public,etc.The third part was the main mode and the enlightenment from foreign system. The fourth part was the problems in the pilot such as the narrow coverage,single insurance organization and defective supporting system. The fifth part was the author’s main recommendations in accordance with the fourth part.I based on the condition of our country, drew the following recommendations:China must establish a compulsory insurance model, expand coverage,establish a diversified insurance agency, complete and perfect the mechanism establishment a reasonable system of public information systems, and alternative riskassessment and damage assessment mechanism, establish accountability regime to recover.I look forward to these recommendations on improving pollution liability insurance.
