The assistants in the superstructure will be qualitative, constraints on his behaviors, based on the legal aspects of the request, provided for the consequences of their actions, performance specification for assistants, elimination of assistants of vaguely defined, legal status ambiguous, safeguard the fundamental rights of assistants.Through analysis of present situation of assistants administrative acts of the executive authorities, arguing the unclear identity, law enforcement, according to the official, arbitrariness of law seriously, and many other phenomena, the current assistants administrative acts of the executive authorities with the above problems, is because of the responsibilities entrusted to the vague and relative questions about power, and personnel quality is not high, caused by relatively high mobility, as well as enforcement procedures are not strict.Finally the author describes optimize assistants countermeasure of administrative acts of the executive authorities, it means that assistants should pass relevant legal system of administrative acts, the establishment of assistants charging system of the administrative act, guide the assistants in three areas to improve its administrative capacity to implement.Assistants are the social development of China at some stage as a specific phenomenon optimization of the governance model, assistants’ dilemma will gradually die out, with the further transferring of power market, and further improvement of the level of the law.
