A Study On Building Chinese Administrative Supervision Commission System

The administrative supervision is a very important system in our country, it is an important means of controlling administrative power. China's administrative supervision system is set up within the government, it is the institution that supervise administrative department, appointed staff and others'execution in nation law, decision and their illegality, so as to ensure the state apparatus to be ordering, coordinating and operating high-effectively. Chinese supervisiory system has procrastinated more than two thousand years, developed from ancient imperial minister supervision to the control institute of the Republic of China and finally to the present administrative supervision. After more than twenty reconstruction years'consummation and development, administrative supervision in our country acquired bumper outcomes, but the current administrative power has not been effective supervised and restricted, abuse of administrative power has occurred from time to time, civil rights have been violated numerous times, corruption has not fundamentally been curbed. Deng Xiaoping, great chief architect of reform and pointed out long ago: "To administer well of our party, achieve our strategic objectives, if we don't punish corruption, especially high-level corruption in our party ,it is really has the risk of failure." "The fundamental reason of social phenomenon is that China is in the economic transition period of corruption-prone, and lack of overall social system in social transition." However, it is clear that, the administrative supervision, as a system focused on supervising administrative power ,is helplessness and inability to control and change this phenomenon. In this article I would like to introduce the current typical administrative supervision of the Sweden and the USA, and then make a deep analysis on our country's administrative supervision, from aspects of system, law and function of China administrative supervision. On the base of the analysis, I would like to put forward the basic thinking about the system and law defaults of our country administrative supervision. On the current system of China, I would like to put forward my suggestion of setting up socialist Administrative Supervision Commission .As the socialist market economy of our country is being improved and the reform of administrative system is being deepen constantly, especially after China has been the member of the WTO, reforming and perfecting present administration supervision is complex social system engineering, we will confront with more new situations and problems. Therefore, how to understand correctly, analyze and resolve these problems, these need to be researched and studied further.
