Study On The Determination Of Some Difficult Problems Of National Staff

Determining national staff on criminal law exists many difficult problems,which are caused by the rapid changes in economic and political system of China, imperfect legal system and relatively backward personnel system.I researched some difficult issues on national staff` through judicial cases.At the insistence of the public affairs theory,I put forward the following points. First,state-owned companies should be limited to the companies that their property are fully owned by the state. University teachers may constitute the crime of corruption, but they do not belong to personnel who engage in public service in state-owned institutions. Second,the "appointment" on criminal law should be based on the state-owned units`warrants. Don`t need to consider theirs’ identities and the forms of “appointment”. The secondary appointment should also grasp the essence. In addition, there could be staff of state organs in the non-state-owned companies, but in practice does not exist.Third,villagers team leaders belong to other persons engaged in official business in accordance with law when to assist the government in its administration in particular. The village Party branch belongs to rural grassroots organizations because of its leadership and functions. Its members belong to other persons engaged in official business in accordance with law when they assist the government in a particular administration.
