The Legislative Research On Criminal Protection Of Commercial Secrets

There are realistic need and theory to use criminal protection on commercial secrets. Although there are several provisions about commercial secrets protecting in our Penal Code which play a good role in economy order safeguarding, the infringement on commercial secrets is barely charged successfully in our country due to the overgeneralization of terms, impropriety of constitutive elements of crime, disproportion of penal discretion etc. This thesis is going to take C-City as an example, combine the judicial status in order to provide some proposals on the legislation of criminal protection of commercial secrets.This thesis can be divided into four chapters. The first chapter will give a brief introduction of the our legislative status. The second chapter will take C-City as an example, figure out the characteristics and shortages of our judicial status of criminal protection of commercial secrets. The third chapter will combine chapter two to make a further analysis on legislation of Criminal Protection of Commercial Secrets. The last chapter will summarize the article and give some legislative proposals.
