Community Correction is the execution ways as opposed to a prison correction, is a great historical change of human execution, in western countries, it has a long history of research and practice value. But it starts late in our country, the community correction pilot program had began since 2003, and in 2009 the national comprehensive pilot program had been put into force. In 2011 the "criminal law amendment (eight)" regulation, which in accordance with the implementation of community correction, just marks the establishment of the legal system of community correction in our country, the reform and improvement of our country penal system laid the foundation base on that. From the practice of community correction work in our country, the rapidly development of community correction needs the current penal system to fit for. Reform the relevant penalty about community correction penal system, is to ensure that the objective requirement of the healthy development of the community correction work in our country.This article selects the probation in the execution of community correction and temporary execution outside prison as the perspectives, first by criminal cases in this paper, the current in the problems and defects existing in the execution of community correction, and then the foreign developed countries related to community correction system, analysis system of the differences between both at home and abroad, put forward how to through the penal system reform to ensure the healthy development of the community correction system.In this paper, an introduction to remove and epilogue is divided into three chapters.The first chapter: the problems existing in the community correction in the executive level. This chapter mainly expounds the specific cases of probation and temporary execution outside prison system in the problems in the execution.The second chapter: compared with the foreign community correction system analysis. This chapter mainly analyzes the overseas relevant system of community correction and for our country and foreign community correction system for difference analysis.The third chapter: the penalty system reform to ensure the healthy development of community correction in our country. This chapter is mainly about the good experience of foreign developed countries for reference, reform from the aspect of legislation and institutional construction level, put forward a series of perfect community correction system constructive opinion to ensure the healthy development of China’s community correction system.
