With the development of the economy, there are more and more environmental problems and disputes. Environmental public interest litigation has become a hot issue. So it is the same with the plaintiff qualification. In the legislation and judicial practice, the plaintiff of the environmental public interest litigation can be summarized into three parts which are administrative organ, the procuratorate and environmental groups. The environmental groups, by contrast, have more advantages. However, because of a short period in development of the environmental public interest litigation and the environmental groups, there’re a lot of limits in the judicial practice. Borrowing abroad experience, we hope that the above problems can be improved.Besides the foreword and epilogue, this dissertation consists of five parts.Firstly, this dissertation introduces the theories of the environmental public interest litigation. And in comparison of the administrative organ and the procuratorate, environmental groups are the optimal plaintiff. Secondly, this dissertation cites the reasons why the environmental groups can be the optimal one. That is the environmental groups play a improvement role in the environmental protection. Thirdly, this dissertation focuses on the judicial practice such as the situations occurred in the environmental groups joining in the environmental public interest litigation and the subsistent obstacles, fourthly, this dissertation researches the abroad experience and obtains some valuable inspiration. Finally and most importantly, in the basis of the above content, this dissertation makes recommendations from three respects.
