Study On The System Of The Witness Protection In Criminal Proceedings

The revised "the people’s Republic of China Criminal Procedure Law" in March 14,2012 by the people’s Republic of the Eleventh National People’s Congress fifth conference by, and come into force on January 1,2013. Marks of criminal litigation in our country has entered a new stage of development. The new criminal procedure law clearly witness obligation, the obligation to testify the specified escape sanctions, but not on the establishment of the system of witness protection add more content. I work in the public security departments long-term, with nearly ten years of experience in criminal investigation, in the process of handling cases, to experience the witness for a variety of reasons to escape the obligation to testify. With the enforcement of the new criminal procedure law time, I feel, attempts to introduce foreign advanced practice of witness protection system, combined with China’s national conditions, proposed the establishment of my suggestions of the witness protection system.This paper is divided into six chapters, the first chapter introduction, describes the necessity of the witness protection system, introduces the related domestic and abroad and the research method of this thesis. The second chapter introduces the basic concept of the meaning and classification. The third chapter introduces some theories about the origin of the witness protection system, the establishment of the system of witness protection value. The fourth chapter focuses on the analysis of the United States, Britain, Germany, South Africa, Taiwan area of the witness protection legislation present situation and advanced experience. In the fifth chapter, analyzes the status of the witness protection system, defects and its causes. In the sixth chapter, the author combines the advanced experience of the United States, Britain, Germany, Taiwan area, put forward the construction of our witness protection system model.
