On The Function Of The Reconstruction Of China’s Administrative Supervision Of Legal System

The operation of administrative power has been of concern to the society, to make the operation of administrative power in the rule of law and good track, not only need to perfect the legislative system, administrative supervision is essential for good. But there is a channel to carry out supervision over the administrative power, has long been in existence has not been given sufficient attention, that is, the system of administrative supervision. This paper from the recent typical administrative power abuse and administrative nonfeasance case is introduced, combined with the author to the administrative supervision organs practice from research, thinking of existing problems of administrative supervision, administrative supervision system has not been analyzed deep reasons due attention, raised the idea of integration of administrative relief attributes in the administrative supervision system, and based on this perspective, the law functional re definition of administrative supervision system, and to summarize the ways of perfecting the administrative supervision system and mode of function. Experience by analyzing the collected cases and our investigation, puts forward the existing problems and thinking of the administrative supervision, analysis the reason behind the deep-seated problems.The second chapter focuses on the reflection and reconstruction of the administrative supervision function. The theoretical definition of the administrative supervision function, to explore the fit the administrative remedy legal attribute and administrative supervision, administrative supervision system is envisaged in the integration of the administrative remedy property after the new essential functions, and carried on the detailed elaboration to the three essential function.The third chapter introduces the strengthening and perfecting the administrative supervision function. Set respectively, from the organization of legislative system, strengthen the function and nature of the supporting system of four aspects to perfect the administrative supervision function.
