The Analyses Of The Legal Regulation Of The Cyber Association

The Internet era, which makes incalculable impact on human society,even on the process of social development, has arrived. The Internet is global property, and that means it belongs to all mankind. The coming of cyber times promotes the marked change of the survival way,the mode of life,the methods of production of mankind,and provide a broader space for the development of civil right of association. With the popularization of networks and the diversify of the application of Internet, there has produced an increasing number of organizations, in which the members communicate each other, share resources, and express appeals via the Internet. However, the Internet brings realistic society convenience; meanwhile it brings an open negative impact, and the cyber association is no exception. Therefore, the cyber association needs legal regulation. It is a newborn thing, and the legal regulation has the characteristic of hysteresis, therefore, in reality the legal regulation on the cyber association shows vacancy to a certain extent. For example, in recent years some cyber associations committed crimes to violate public order and good custom, attracting public doubt and jurisprudential circle’s discussion. The cyber association is different from the realistic association, and it has its own features, so its legal regulation should adopt different ways.This paper tries to analyze the definition, characteristics of the cyber association, to explore the consciousness of right behind the cyber association, to research its legal predicament, and to present proposals on its legal regulation at last.
