The Research Of The Local People’s Congress Supervision Of The Court At The Same Level

Supervisory system of National People’s Congress is an important part of China’s political system, and the place National People’s Congress for the supervision of the court of the same level is an indispensable element. According to the relevant provisions of the constitution of our country, the local NPC shall have the power to supervise the court which must be responsible in terms of trial independence. But, the place National People’s Congress also cannot too much exercise the power of supervision, it should be in the premise of judicial independence to prevent from intervening the trial work. Currently, the palace National People’s Congress made a lot of achievements on the supervision of the court of the same level, for instance the consciousness of supervision constantly strengthened, monitor routine constantly consummated and the procedural provisions of supervision constantly improved, which plays a positive significant effect on the course of justice. But because the supervision institution and the supervision mechanism are not perfect,supervision means exercised properly and the methods of supervision is not standard, the local NPC has a great deal of problems in the supervision of the court of the same level. Currently, our country is in a significant period of deepening the reform of judicial and to strengthen the supervision on court has became the important content of the work of the NPC’s supervision. This paper which expounds the present situation of the system discusses the theoretical basis of the system, analyses the chief issues existing in the current supervision activities and puts forward the countermeasure to perfect the way. The author’s intent is through the above four parts to conduct a comprehensive, specific description, and let the readers have a deeper understanding and grasp of the system and try to explore a new framework of the new system to improve the system.
