On Social Administrative Body

Administrative subject theory has been the basic theory of administrative law science. With the change of government function, the development of the socialization of state power, the administrative subject presents the trend of diversified development. Although the Social administration subjects named differently all over the world, but it derives from a long history. The social administration subject and the national administrative subject constitute public administrative subject. As part of the administrative subject, establishment and improvement of the administrative subject is the necessary requirement to provide public service supply efficient and the development of administrative subject diversification, safeguard of the legitimate rights and interests, and perfect the system of administrative law.This article aims to analysis the connotation of social administrative subject in detail by use of semantic analysis, comparative analysis, empirical analysis and other research methods, and by analysis of the definition and characteristics. The article applies the method of comparative analysis on the practice of the foreign social administrative body, summarizes foreign social administrative body practice, in order to provide experience for the improvement of the administrative subject and build. The lack of social administrative subject theory of guide to practice in our country presently make it urgency to construct the system of the social administrative subject.The development of the people autonomy democracy and rational consciousness in our country,the change of government function and implement of partial administrative decentralization, the strengthen of independence of NGO, the cultivation of the growth of the non-governmental organization and the complement of the related legal system,all above provides a feasible basis of social administrative subject theory construction and practice in our country. In the face of the reality of our country, on the one hand, we need to complete the social administrative body theory and establish the law status of social administrative subject. On the other hand, we are suggested to perfect our country social administrative body practice, clarify the classification of social administrative subject, devise the limits of power of social administrative subject reasonably, exercise the administrative subject’s power regulating, safeguard the independence of the social administrative subject, improve the regulatory mechanism of social administrative subject.Under the background of the comprehensively promotion the rule of law and the change of government function, we have lots of work to be down at this stage.
