Four Comprehensive Study Of The Regulation Of The Social Role Of The Four Laws Perspective

After about40 yearsofopening and reform policy, theconstruction of socialism with Chinese characteristics hasobtained remarkable achievements with its economic power ranking among the top all over the world and its significantly improvement of comprehensive national power. At present, the process for building up moderately prosperous society has be-en halved. China is at the turning point of reform and opening and the reform is in the crucrucialpointand most difficult point, therefore, it faces various social problems, such as uneven development, differentiation of all levels in the society, frequent occurrence of society conflicts,andurgentneeds for changing the economic development mode as well as severe corruption and so on. Meanwhile, the social life in China, people’s mindsets and values as well as concepts change greatly. Undoubtedly, the convening of 18 thParty congress has important historical significance so as to make the welfare of reform and opening being beneficial to more people. It faces directly to all the difficulties and challenges during the opening and reform and is brave enough to respond to the attention of the era and the public by putting forward the goal of comprehensively construction of socialist society. In the Third Session of 18 thcongress, it proposes the idea of comprehensively deepening reform and the Fourth Session puts forward the strategic layout of comprehensively governing the Party strictly on the basis of comprehensively implemented of rule by law and summarizing the educational practice of mass line. The“FourComprehensives”is the important strategic layout for us to deeplyunderstanding the law of socialist modernization and the ruling laws of the Party under the new era of governing the country.Under the strategic layout of“Four Comprehensives”, it can better sustain the social stability and realize the goal of comprehensive construction of moderately prosperous society by completely fulfillment of rule by law and better implement the influence of law in social control. As the most important and basic method, law plays an irreplaceable rule in allocation of interests in social life, resolving social conflicts, responding to the social concern, sustaining the social fairness and justice and maintaining the harmony and stability of social orderness. Therefore, under new social condition, the construction of rule by law has come to a new stage. It is of great theoretical significance and great realistic significance to better invoke the admittance and awesome of law for the society and people, better implement the influence of law in social control and promote the construction of rule by law in China.Starting from the better realization of strategic layout of‘Four Comprehensives’, this paper analyze the objects, features and function of law in social control on the basis ofsummarizing and reviewing the development trend of social control. What law adjusts and controls is social relations and social process which is independent of man’will. It represents the willingness of ruling class. However, with the development and changes of society, the controllingobjects of law havechanged as well. Its control for society is official and external. At present, law and morality is the main controlling methods for society. This paper compares restricts and harmonious parts between each other. As the basic social controlling measures, law endows social control with certainty and execution power, which is the guarantee for social control. Therefore, at the period for comprehensively promoting the rule by law, China should better enhance the guidance by Party, comprehensively promote the administrative by law and building up a law-based government to publicize the notion of democracy and rule by law so that it can better implement the function of law in social control and better constructthe socialistic country rule by law and better realize the strategic development goal of“Four Comprehensives”.
