Research On Control Mode Of DUI Crime Prevention

As a special social phenomenon,crime has always plagued human society.People have been trying to eliminate crime for a long time,but historical experience has taught us that crime can not be eliminated and can only be controlled to some extent.In terms of crime control,China mainly relies on the "State-standard" model of crime control,which mainly relies on the specialized state forces to control crime,and which can indeed play a good role in the case of a single form of crime.However,with the increasing complexity of the social environment,the increase of social risks and the increase of criminal inducement,the model of crime control with the state as the leading force is difficult to adapt to the current demand for crime control.In particular,with the general improvement of public awareness of the law and the advent of the media era,some vicious road traffic accidents caused by drunk driving(including drunk driving)have caused serious damage to public safety,and various traditional media and self-media have been widely disseminated.The social impact is greater.Drunken driving,as a criminal act,is a crime with the lowest legal penalty and a small range of penalties in the criminal law,but it is a crime with high public attention.Based on this,during the period since the "Amendment(8)of the Criminal Law of the People’s Republic of China" was formally implemented on May 1,2011,the theoretical and judicial practice circles have conducted statistics on drunk driving(including drunk driving)data in different regions and at different stages.Summary,The practical effect of DUI is further demonstrated,and it is found that DUI does have certain effect on punishment of this kind of crime to some extent,but whether the continuous effect is the same as the expected effect needs to be further combed and demonstrated.At present,the control of drunk driving is mainly based on legal control,and social control is in the preliminary exploration stage.From the perspective of the current governance of drunk driving,especially after drunk driving is sentenced,a series of problems arise such as: drunk driving cases occupy huge judicial resources;Drunken driving cases bicycle accidents,no harm to the result of criminal responsibility for many...and other thorny issues.In response to the above problems,it is not possible to rely solely on the state forces to control thecrime of drunk driving.It is necessary to use reasonable institutional design and arrangements to change the past state-dominated crime control model into a dual model with both state and social forces.It is also in line with the current trend of international crime control to involve social forces and expand the channels of social participation to assist the public power of the country in controlling.This paper analyzes the controlling subject,controlling object,controlling object,etc.from the control mode of DUI crime,according to the control mode theory,so as to clarify the basic theory of crime control mode.It is concluded that the current crime control mode of DUI in China is divided into legal control and social control.On this basis,starting from the empirical aspect,through combing the judicial data of the DUI case in recent years,analyzing the problems and difficulties existing in the DUI control model at the present stage,analyzing the reasons for the existing problems,and combining with the foreign control of DUI crimes.This paper puts forward that we should explore the mode of DUI crime control based on legal control and supplemented by social control.This paper takes the relevant data of DUI in L city of Gansu province as a sample,and proves the problems that need to be discussed in this article.Through analyzing the sample,it can fully confirm the arguments put forward by the author and has certain theoretical and applied value for the current DUI control problem.
