The Theory Of Sentencing Standardization Construction

The discretion of punishment standard and sentencing into court proceedings (referred to as "the standardized sentencing reform"), is a key project of the Central Committee of the Communist Party of the establishment of the judicial reform, and it is also an important content of people’s court third five year reform program. At present, the standardization of sentencing reform is in the pilot phase, the pilot phase of the comprehensive rational analysis can provide objective experience for the full implementation of the reform, to avoid trouble. In this paper, based on the United Kingdom and the United States, Germany and Japan, four countries in the sentencing standardization construction experience for reference and empirical research on the sentencing procedures, Guangxi area investigated some empirical research, based on a careful analysis of the main problems existing in the process of reform of China’s sentencing standardization in the end, the existing problems, trying to reform makes a further prospective study, in the hope of sentencing standardization reform as soon as possible.
