As the real estate of regulation pattern recently reveals, group buying of commodity house is strongly favored by many buyers. The legal relationship of group house buying is complex, and the group buying industry is lack of unified legal norms. It is difficult to define the main body of legal liability in practice, so disputes of buying houses happen frequently. Based on the perspective of theory of civil law, this article analyzes the legal relationship of commercial housing group, and studies the risk of the commodity house deals and regulations. Besides, this article also gives some feasible methods on how to perfect the group buying of commercial house.This article consists of four parts, which are as follows:The first part is the special risks and regulations in unit-organized group buying of commercial house, which is:analyzing legal relationship of unit commodity house buys; putting forward the corresponding measures to prevent the risk in the frequent unit housing index transfer, unit group purchase pre-sale and finance.The second part is the rules and regulations for special risks of website organization of commodity house buying, which is:analyzing the legal relations of the network group purchase commercial housing; the summarizing and finishing existing network group buying false preferential risks, risks of group-buying market access system was, and putting forward the method to standardize the development of the network group buying.The third part is the specific risks and rules of commercial housing consumers organize group, which is clearing the legal responsibility of group legal risk prevention through the analysis of the group of consumers to organize the legal relationship from the perspective of theory and judicial practice.The fourth part is the common risks and rules of group-buying housing model. By analyzing several kinds of risk, the paper puts forward to perfect the legislation, which is subject to the generality of the group-buying model for group buying fund regulation and difficulties for the rights of common problems in group purchase. It also recommends establishing housing follow-up management mechanism, credit guarantee mechanism, and effective prepaid funds management system to improve the relevant system of the real estate group purchase.
