| Traditional non-commercial risk prevention and legal coping strategies can’t adapt to the need of modern overseas investment enterprises.When our country enterprises expanse vigorously among overseas markets,the political unrest, economic unbalances, terrorist attacks, aggressive war, natural disasters, epidemics diseases, the network hacker attacks and other non-commercial risks happened to our country enterprises overseas investment time and time again that cause heavy property damages.As one of big economic province in our country, Jiangsu Province enterprises probably lose everything because of the lack of non-commercial risk preparedness and coping strategies with the growing overseas investment.It is worth noting that the study of Jiangsu overseas investment non-commercial risk far behind the present situation of the overseas investment.The current literature and researches stay on the phenomenon description and shallow analysis of the risk.The deep reasons of the occurrence of these non-commercial risk and the methods of controlling still lack precise analysis. The lack of risk early warning information and legal strategies contribute to Jiangsu’s blind and random overseas investments. The blind forecast of market and random investment make those enterprises become disoriented when risks occurs.This is not only hit the confidence of the "Going Out" enterprises in Jiangsu Province, but also badly restricting the sustainable development of the Jiangsu Province economy.In this context, the researches of Jiangsu overseas non-business risk preparedness and law strategies are particularly important. This paper adopts the data method, case analysis, comparative research and interdisciplinary study research methods to do analysis. By analyzing a large amount of data of Jiangsu overseas investment basic situation and the new type of non-commercial risks which impact on jiangsu enterprises overseas investment. Analyze shortcomings and blank space of Jiangsu current law and strategies about overseas investment non-commercial risk protection to put forward relevant legislative suggestions.Finally,combining with the characteristics of Jiangsu enterprise to propose several suggestions about constructing Jiangsu Province enterprise’s non-commercial control system.In general, only to establish a complete non-commercial risk legal control system of preparedness and response,can we provide better reference and methods for Jiangsu enterprises against future non-commercial risk on overseas direct investment, and help overseas investments carry out smoothly. In the end, we can do contributions to helping Jiangsu economy develop healthily and continuously. |
