Research On The Perfection Of The Openness Of Procuratorial Work

The openness of procuratorial work means that the procuratorial organs tell procuratorial functions and powers to the society and the participants in accordance with the law and related not involved in the state secrets and personal privacy and so on related activities and matters。The openness of procuratorial work was firstly put forward in 1998 by the supreme people’s procuratorate and then it was promoted from pilot to the whole country。The openness of procuratorial work had made clear grades since it was promoted with attention and support from the society.The openness of procuratorial work is one of the important measures to implement "Sun procuratorial" by the supreme people’s procuratorate which purpose is to strengthen the supervision of prosecutorial affairs,to improve the quality and service consciousness of prosecutors spare,to protect citizens’ lawful rights and interests so that to consistent with the government information publicity.The procuratorial affairs accept social supervision is conducive to the impartiality of procuratorial authority and is advantageous to the procuratorial organ to perform supervision function better. The openness of procuratorial work can not only guarantee citizens’ right to know but also open up a window for social supervision and procuratorial work.It is important to note that a series of difficulties and problems also appeared in the openness of procuratorial work and it depends on more complete system to solve these problems.The system is the guarantee work ,solve the difficulties and problems are the breakthrough to further improved the system.Combining with the basic theory of the openness of procuratorial work, and study clearly, to find and study the problems and reasons about the openness of procuratorial work which is universality and regularity so that to perfect the openness of procuratorial work and ensure that the work further.Along this line, this thesis begins with the basic concepts and nature of the openness of procuratorial work, combining with the process and theory of the openness of procuratorial work and summarize the principles ,scope,content and main form of it. Then the paper study the shortcoming of the openness of procuratorial work on theory and practice and gives some meaningful opinions and suggestions, hoping that I can give some help to improve the openness of procuratorial work.The thesis is consist of four parts:Firstly, the overview of the openness of procuratorial work, introducing the basic meaning and nature and the basic situation of it on three stages which are pilot phase,repair the promotion and institutional deepening stage. Clarifying the theoretical basis and legal basis of the openness of procuratorial work to proving that the reason of that how the openness of procuratorial work can be implemented in the whole country is that it is always being produced and completed by recall the process of the openness of procuratorial work combining withe the related theory and legal provision.Secondly,the principles, content and scope of the openness of procuratorial work introducing the four principles of it,explaining the main content,scope and form of it and analysis it dialectically combining with the fact to prove that the openness of procuratorial work needs innovation continually. The standard and related system of the openness of procuratorial work also need to keep pace with the times.Thirdly, this part expounds the theory shortcoming of the openness of procuratorial work, that’s about the content, system, standard and the procuratorial informatics in practice. Theory is not enough and the openness of procuratorial work lacks theory guidance with prospective, this problem hinder the further development of the openness of procuratorial work. The purpose of this part is to introduce that the work to perfect the openness of procuratorial work is the basic purpose to solve the problems and promote the work now.Fourthly, put forward concrete suggestions from the macroscopic and microscopic to the openness of procuratorial work. In microscopic aspect, we should perfect the information announcing system,prove hearing system, improve the secrecy system, expand the channels from which parties can take part in the procuratorial affairs, and also the review system and procuratorial consulting system should be proved, we should also strengthen the procuratorial information database. In macroscopic, the paper advises that we should make a system specification soon, perfect the security system, and strengthening the construction of the organization.
