The Responsibility Of Prosecutor System Research

The responsibility of prosecutor system is the key of Chinese Judicial Reform which reflects the requirement of prosecutorial power in motion.The scientific responsibility of prosecutor system is very important for increasing quality of personnel,working efficiency and quality. Many positive reforms are tried and explored.The chief prosecutor system and the head prosecutor system have been implemented. The chief prosecutor system did not solve the problems of administrative trend in procuratorial practice.To further promote the responsibility of prosecutor system, reformers launched the head prosecutor system. They hope to establish a set of powers, duties, consistent with the interests of the responsibility of prosecutor system.According to the deployment of the Supreme People’s Procuratorate, the head prosecutor system is mainly organizational form currently.The system reform is still in the initial stage. For now, even though some results have been achieved, there are still many problems need to be solved.The purpose of this paper is to summarize the experience of the responsibility prosecutor system reform practice and the successful experience about this system outside.On this basis, this article put forward the suggestions of perfecting our country’s responsibility of prosecutor system.The full text is divided into four parts:The first part, General legal of prosecutor case responsibility system. It mainly explains its meaning and value.The second part, The Foreign Investigation of prosecutor case responsibility system. It describes the system in France, Germany, Japan and Taiwan of China. Overseas experience includes lines of authority, handling organizations, responsibility and security, etc. These have significant reference value for our country.The third part, Experience and problems of the reform. The chief prosecutor system and the head prosecutor system are summarized with their main content, effects and problems such as lack of legislative support; powers, duties, interest can not be reconciled; lack of relevant supporting systems.The forth part, Recommendations to improve the responsibility of prosecutor case system. On the basis of the above analysis, the author propose ideas of improving the responsibility of prosecutor case system. Firstly, we must clarify the legal status of the prosecutor.The second is to define the boundaries of prosecutor’s duties and responsibilities. The third is to innovate the procuratorial management mode. The fourth is to improve the cultivation of the prosecutor, selection, evaluation and personnel flow mechanism. The fifth is to establish prosecutor safeguard mechanism.
