Research On Legal Protection Of Motion Mark

In the era of information technology, the Internet has deep into every aspect ofpeople’s daily life. Our life has entered into the digital age. To keep up with the paceof development, World Intellectual Property Organization(WIPO) has approved the《Singapore Treaty on the Law of Trademarks》 in2007, which specified motionsymbols can be protected as being used in trademarks and formulated the registrationprocedure. It makes the register of motion marks operable. The United States and theEuropean Union have typical cases of motion marks registration. Their registrationpractice and litigation practice of motion marks can be our reference to establish ourown registration system.In chapter one of this paper, I will list and analyze some of the definition ofmotion marks from different scholars，and also state the possibility of registration ofmotion marks. I will as well introduce the character and classification of the motionmarks with reference of authoritative document.In chapter two of this paper, I will discuss the motion marks registration practiceand cases in the United States and the European Union, also find out the advantagesand disadvantages of current registration system. And raise some operable advice tosolve the problem and establish the better registration system for motion marks.In the last chapter of this paper, I will combine the experience on motion markspractice in the United States and European Union to our country’s improvingprotection practice of motion marks.
