Illness and death is a natural law of human development. No matterwhen and where, suicide is a common phenomenon in human society.Especially with the progress of the technology, increasing pressure andconflicts, suicides increased year by year. For the legal nature of assistedsuicide, there is still no unified conclusion. So I compared our country’slegislative situation with others, analyze the discussion in theorists, in order tofind out the legal position of the assisted suicide behavior. There are fourchapters in the thesis.The first chapter is an overview of assisted suicide. I definite the suicidefrom subjective and objective aspects that suicidal behavior must becommitted by a person of criminal responsibility with a fully independent andvoluntary. the suicide is lack of penalty. On this basis, according to differentclassification criteria, assisted suicide can be divided into spiritual help,material help, active help, passive help, unilateral help, suicide pacts help.The second chapter discusses the legislative and judicial situation ofassisted suicide. First, analyze the law of foreign countries about assistedsuicide. Then analyze the situation of our country’s legislature and thedifference between China and foreign countries. Second, analyze the judicial situation, cited a number of cases of judicial practice, and the differentjudgments.The third chapter is discuss the different opinions about assisted suicidein theory. Someone think assisted suicide is intentional homicide, someonethink assisted suicide is not intentional homicide; criminal law shouldindependent conviction, someone think assisted suicide is no guilty.The fourth chapter makes a conclusion that assisted suicide is no guiltyaccording to analyze the social harm, criminal illegality...
