The Analysis Of The Degree Dispute Case Of Hu Baoxing Suing Huazhong Agricultural

The academic degrees system of PRC was proposed in1980s which was later. In the thirty years, the very system has played an important role in our country’s education. However, with the development of times, the establishment of socialist market economic system and the continuing boost of legal society, the academic degrees system whose core is Regulations of the People’s Republic of China on Academic Degrees has been impinged continually, and affair of student suing their universities for academic degree occurs constantly. The problems of the present academic degrees system are more and more obvious and need to be reformed urgently.This thesis takes the degree dispute case of Hu baoxing Suing Huazhong Agricultural University as the point of penetration. Firstly, it expounds the court’s judgments and basis, introduces the point at issue, and analyses its legal problems. Secondly, it discusses several problems exposing in the said case, such as the lagging codes and regulations in our country’s present academic degrees legislation, the conflict between the rules for implementation of the academic degrees awarding of university and super ordinate law, etc. Lastly, it proposes the writer’s suggestions, which are to deepen the reform of academic degrees system, to promote the legislation and issuing of Academic Degrees Law and to solve the academic degrees dispute problems progressively basing on laws. The writing of this thesis depends on the way of throwing away a brick in order to get ages. It puts forwards the writer’s opinions and suggestions, in the hope that our society, especially the jurisprudence circle and the judicial circle can pay more attention on the legislation of academic degrees laws and can put forwards the reform of academic degrees system gradually.
