On The Legal Regulation Of Degree Revocation In Chinese Universities

In recent years,with the increasing of students' legal and right protection awareness,the number of dispute cases in academic management with universities,especially due to degree revocation,and finally resorting to the court for judicial relief is on the rise.Many problems have been exposed in these cases,On the one hand,they reflect the deficiency of degree law;on the other hand,they also reflect the universities' own problems,such as the lack of due process.This paper takes the case of Yu Yanru prosecute Peking University and Chen Ying prosecute Sun Yat-sen University to analyze problems existing in the degree revocation of Chinese universities.Analyze and summarize the experience of American degree revocation,and finally achieve the goal of legal regulation of degree revoking in universities Besides the introduction,the text is divided into four parts:The first part summarizes the related concepts of degree revocation in China.It is necessary to have an in-depth understanding of degree revocation,including the history and concept of degree,relevant concepts of degree awarding and degree revocation,and the nature of degree revocation.The second part analyses the specific problems in the withdrawal of university degree in China through the case of Yu Yanru prosecute Peking University and Chen Ying prosecute Sun Yat-sen University,which have great social repercussions in recent years.The main problems include the lack of the principle of due process in the process of degree revocation,the legal basis for revocation,the standard of academic degree awarding,and the lack of effective protection for the relief of students' rights.The third part lists the experience of Americans' degree revocation,which Is completed in the world,sums up the characteristics of experience,and extracts the experience that China can be used for reference in the legal regulation of degree management in colleges and universities in China.The fourth part puts forward Suggestions on the legal regulation of the major problems existing in degree management in China,including:The establishment of university degree revocation must follow the principle,establish a third-party supervision mechanism,and improve laws and regulations.
